Terms and Conditions
Applicability of the General Terms and Conditions
These General Terms and Conditions (GTC) apply to all offers and services provided by McParking Germany GmbH (Gebrüder-Hirth-Str. 27, 12526 Berlin, www.mcparking.de). McParking does not recognise any terms and conditions of the customer that conflict with or deviate from these GTC, unless McParking has expressly agreed to their validity in writing. McParking’s GTC shall also apply if McParking performs the services without reservation whilst being aware of terms and conditions of the customer that conflict with or deviate from these GTC.
McParking’s offers are subject to change. Contracts are only concluded once McParking has confirmed the customer’s booking enquiry.
Rental Agreement
McParking offers passengers at Berlin Brandenburg Airport the opportunity to park their vehicle in the car park operated by McParking for a fee and to use the shuttle service provided by McParking to and from the airport once free of charge.
(1) McParking shall make the booked parking space available to the customer for the agreed booking period in accordance with the following provisions.
(2) For pre-paid bookings, the booked parking space will be reserved for the entire agreed booking period. The customer is entitled to enter the booked parking space once, no later than the booked exit time.
(3) For bookings not paid in advance, the booked parking space will be reserved for a maximum of 24 hours from the agreed entry time. If the customer does not enter the site within this period, McParking is entitled to allocate the parking space to another party once the 24 hours have elapsed.
(4) In this case, the customer remains obliged to pay the originally agreed total price, regardless of the parking space being reallocated. Invoicing takes place after the expiry of the originally booked period.
(5) In the case of bookings not paid for in advance, the customer’s right to use the parking space ends upon the release of the parking space in accordance with paragraph 3, provided that entry has not taken place by that time.
(6) The booking is deemed to have ended upon the customer’s exit from the car park, even if a longer booking period was originally agreed. In this case, there is no entitlement to re-entry, further use of the parking space or a pro-rata refund for any unused remaining time.
(7) A valid booking or reservation permits only a single entry and a single exit. An interruption of the parking period, in particular through a temporary exit followed by re-entry, is not permitted.
(8) The customer has no entitlement to a specific parking space unless this has been expressly agreed in writing. When booking the “Car Park incl. Transfer” product, a covered parking space is not guaranteed. The car park has a total of 8 levels, of which the top level is not covered. During periods of high demand, McParking is entitled to allocate customers to this top level.
McParking endeavours to fulfil all customer requests and bookings in full; however, deviations from the plan may occur, e.g. if customers collect their car late (e.g. due to flight delays or cancellations).
(9) In the event of booking a parking space including a charging service (electric car), the customer is obliged to additionally leave the vehicle key with McParking. McParking is entitled to move the customer’s car to another parking space, provided the charging process has been completed, in order to be able to offer the charging service to other customers when the parking spaces with charging points are fully occupied.
(10) In the event of the customer’s early return, there is no entitlement to a refund of the fee, except for customers who have booked the McParking money-back guarantee. If a customer has booked the McParking Money-Back Guarantee and returns early (at least 24 hours before the booked exit time), McParking will only charge for the actual parking duration, in accordance with the price list valid at the time of booking. The customer will be refunded the difference between the booked and actual parking periods, as well as the €5 from the money-back guarantee.
(11) McParking is entitled to a right of retention and a statutory lien on the customer’s parked vehicle in respect of its claims arising from the rental agreement. Any transfer of user rights to third parties is excluded.
(12) If the customer does not remove the vehicle after the rental period has expired, there shall be no tacit extension of the rental agreement for an indefinite period. In this case, McParking may claim compensation for the duration until the vehicle is removed. The costs incurred amount to EUR 10.00 for the first day of overrun and EUR 10.00 for each subsequent day.
(13) If the booked parking period is knowingly and intentionally exceeded by the customer, we reserve the right to have the customer’s vehicle towed away. This applies in particular if the car park is fully booked and a customer knowingly provides false information in order to obtain a parking space at short notice. Exceptions apply only if the customer can prove that the parking period was not exceeded through their own fault and they notify McParking in good time.
Changing the booking period / rebooking
A change of the booked period to a different date via the booking login is generally only possible in the cases set out below:
(1) Provided the customer has not taken out cancellation cover, the booking has already been paid for in full in advance, and the booked entry time is 24 hours or more away, a one-time rebooking is possible. This can only be done via the booking login and the ‘Rebook parking period’ button there. The customer will receive a voucher code for the amount originally paid, which can be used to book the desired new period. Once the new booking is completed, the previous booking expires.
(2) For unpaid bookings, rebooking via the booking login is not possible. In this case, the customer must contact customer service at info@mcparking.de to change the booking period.
(3) If the booking was made with cancellation cover, the existing booking must be cancelled and a new booking made. The customer will be refunded the full amount for the cancelled booking.
(4) If, in exceptional circumstances, the start of the booked service is to be brought forward by one day, the customer may also contact customer service at info@mcparking.de. In this case, subject to availability, Customer Service may bring forward the entire booking period by one day. In this case, the departure date will also be brought forward by one day accordingly.
(5) Any further changes to the booked dates are excluded. Unless otherwise expressly provided for in these terms and conditions, the existing booking must be cancelled and a new booking made.
Additional options
Cancellation cover
(1) Cancellation cover can only be added when making an online booking in conjunction with an online payment for €5.00. It is not possible to book cancellation cover retrospectively.
(2) By booking cancellation cover, the customer is protected in the event of cancellation and will receive a full refund of the parking fee paid, provided that the cancellation is made by the end of the booked arrival day at the latest and the vehicle has not yet entered the car park.
(3) Cancellation may be made either a) in writing or b) via the booking login.
(4) Vouchers are not taken into account in the event of a refund. Only online payments will be refunded.
(5) If cancellation is not made in good time in accordance with the above provisions, there is no entitlement to a refund of the parking fee.
Key deposit
(1) When booking the additional option “Key deposit”, the customer must report to McParking staff after parking and hand over the vehicle key.
(2) The vehicle key is kept securely in a safe by McParking staff and returned to the customer upon their return.
(3) Upon request, the customer must provide suitable identification to verify their identity when collecting the vehicle key.
Charging service (electric car)
(1) By booking the additional “Charging service” option, the customer reserves a charging bay for their electric vehicle.
(2) The customer parks the vehicle at the allocated charging bay and hands over the vehicle key to McParking staff.
(3) McParking will fully charge the customer’s vehicle once and then terminate the charging process.
(4) There is no entitlement to further or repeated charging processes, unless expressly agreed otherwise.
(5) Upon request, the customer must provide suitable identification to verify their identity when returning the vehicle key.
XL Parking
(1) The “XL parking space” add-on is available for vehicles with a length of 5.50 metres or more and up to 6.50 metres.
(2) Customers who have booked an XL parking space must report to McParking staff before entering the car park.
(3) McParking staff will then allocate a suitable XL parking space to the customer.
Conduct on the premises
The provisions of the German Road Traffic Regulations (StVO) apply on the McParking premises. Vehicles must be driven at walking pace throughout the premises. The customer must observe the traffic signs and comply at all times with the instructions of McParking staff and their agents and representatives. All customers and accompanying persons must behave in such a way as to avoid causing nuisance, danger or harm to third parties.
Vehicles may only be parked within the marked parking spaces. In doing so, the customer must ensure that other vehicles are not obstructed, particularly with regard to the unhindered entry into and exit from adjacent parking spaces. Should a customer’s vehicle be parked in such a way that it obstructs other customer vehicles already parked there to the extent that they cannot leave their parking spaces, McParking is authorised to have the obstructing vehicle towed away and to charge the owner the costs of the towing plus an administration fee of EUR 50.00 plus VAT. The customer reserves the right to prove that the damage was less. Where the customer is allocated a specific parking space, the customer is obliged to park their vehicle exclusively in the allocated space. Once the vehicle has been parked, the customer is obliged to lock the vehicle properly and secure it in accordance with standard practice.
By entering the McParking premises, the customer warrants that the driver holds the necessary driving licence and that the vehicle is covered by the legally required insurance until it leaves the premises. The customer is prohibited from carrying out repairs on vehicles, washing or cleaning vehicles, draining coolant, fuel or oil, dispose of rubbish, store items of any kind (in particular operating fluids, flammable objects, empty fuel containers, tyres, bicycles, etc.), test or run engines, or park vehicles with leaking fuel tanks or engines. Any contamination caused by the customer or their companions must be removed immediately and properly by the customer. If they fail to do so, McParking is entitled to remove the contamination at the customer’s expense. In the event of contamination of the ground or groundwater, the clean-up must be carried out by an authorised specialist company at the customer’s expense; in such cases, the customer is not entitled to carry out the work themselves. It is not permitted to remain on McParking’s premises for purposes other than parking and collecting vehicles, loading and unloading, or whilst waiting for the shuttle. McParking is entitled to refuse to allow a vehicle to be parked on the McParking premises in the event of imminent danger, and to remove vehicles from the premises in the event of imminent danger.
Smoking is prohibited on McParking’s premises. Smoking is permitted only in designated areas.
Shuttle service
Hire car park users on the McParking premises are entitled, subject to the following regulations, to use the shuttle service from the McParking premises to the airport specified in the booking confirmation and back.
Use of the shuttle service requires a valid booking, the full details of the passengers to be transported, and the booked vehicle having been checked in at McParking. At the Berlin site, check-in is completed by passing through the entrance barrier. McParking staff and persons authorised by McParking are entitled to verify the validity of the booking, the booked vehicle, that check-in has been completed, and the number of passengers booked prior to each journey.
Persons not included in the relevant parking booking are not entitled to transport. This applies in particular to persons who do not park a vehicle on the McParking premises, who park on public roads, in the surrounding area or on third-party land, or who arrive in additional vehicles not booked with McParking.
For each booked parking space, the number of people entitled to use the shuttle service free of charge is the number correctly stated at the time of booking. Only a maximum of the number of people for which the vehicle is registered may be specified per vehicle. The vehicle must be checked in with all booked passengers by passing through the entrance barrier. For each booked parking space, the shuttle service includes a single journey from the McParking premises to the airport and a single journey from the airport back to the McParking premises. For additional shuttle journeys, a fee of EUR 10.00 is payable for each journey made. At the Berlin-Brandenburg locations, an additional charge of EUR 5.00 per person and vehicle applies from the 6th person onwards, provided that McParking confirms the transport of the additional persons. Persons not declared or declared incorrectly may be excluded from transport. The same applies if the stated number of passengers is exceeded, if passengers without a valid parking booking wish to use the shuttle service, or if there is a suspicion that passengers from unbooked vehicles or from outside the McParking premises wish to use the shuttle service. In such cases, parking or shuttle fees already paid do not entitle unbooked or unauthorised persons to be transported.
In the event of high passenger volumes, McParking reserves the right, in the interests of all customers, to give priority to or exclusively transport the drivers of booked vehicles in extreme situations, particularly in the event of traffic jams, flight delays, exceptionally high passenger volumes, operational disruptions or similar circumstances. A maximum of 1 suitcase weighing up to 32 kg per customer and their authorised accompanying persons will be carried free of charge. McParking is only obliged to carry excess and bulky luggage following a separate written agreement. Without such an agreement, oversized and bulky luggage must be transported to the airport by the customer themselves before parking begins.
At the McParking site in Berlin-Bohnsdorf, a large shuttle bus operates at fixed departure times. Customers must ensure they arrive at the relevant site in good time, in particular in good time for check-in at the airport.
Transport to the airport is provided to the stop designated by the airport operator, which is as close as possible to the terminal where the customer’s check-in counter is located. McParking is only liable for late arrival at the airport if the customer’s details are complete and correct, the customer is ready to use the shuttle service at McParking at least 30 minutes before the start of the check-in time specified by the respective airline, and the customer misses their flight due to a fault for which McParking is responsible. Liability for delays due to force majeure, as well as for delays caused by traffic, official orders or other reasons for which McParking is not responsible, is excluded.
Return transport from the airport to the McParking premises shall be provided in accordance with the current bus timetable or the shuttle regulations applicable at the respective location. McParking is entitled to refuse carriage to persons who are intoxicated, disorderly, aggressive or otherwise disrupting operations or safety. Fees already paid will not be refunded in such cases.
McParking may also arrange for the shuttle service to be provided by third-party companies, in particular bus companies, taxis or car hire companies. Such arrangements are made exclusively by McParking and do not result in any additional costs for the customer. In the event of diversions, alternative landings or arrivals at other airports, McParking is not obliged to collect the customer from the respective alternative airport.
Prices and Terms of Payment
The daily rates stated apply to the parking services offered by McParking for each calendar day or part thereof, even if the customer only uses the parking services offered by McParking for part of the respective calendar days. The customer shall pay the agreed prices in advance without deduction, either by online payment after booking or on departure. If the customer does not accept the agreed services from McParking, they remain obliged to pay the agreed fee to McParking, subject to any conflicting statutory provisions. No further reductions or discounts shall be granted on discounts already applied. Should prices be incorrectly displayed on the internet due to technical faults, the price lists displayed at the car park shall apply in all cases, provided that it was clear and unambiguous to the customer that the prices on the internet were incorrect. Otherwise, the contract remains valid; however, McParking may have grounds for rescission, which may be invoked immediately upon becoming aware of the error (incorrect price on the internet). When redeeming promotional vouchers, the customer will not be refunded any difference, even if the voucher value exceeds the parking price; booked additional services will not be deducted from the voucher value and no double discounts are permitted. The ADAC member discount can only be deducted from the price upon presentation of a valid ADAC membership card. McParking reserves the right to charge an increased parking fee of up to 100% should the customer park outside the parking space markings and thereby block a second parking space. If a booking is not made independently by the customer via the designated online booking system www.mcparking.de, but instead by telephone, email or in person on site with the assistance of a member of staff, a service charge of €10.00 per booking will be applied. This surcharge is shown separately to the customer as part of the booking (booking by staff) and is payable together with the total price. For on-site payments at the exit, the payment receipt is provided exclusively in digital form and can be accessed, saved or printed using the QR code displayed at the terminal/location. This requires an internet-enabled device and an internet connection; any connection costs incurred shall be borne by the customer. If retrieval is not possible due to a technical fault within the operator’s sphere of responsibility, the operator shall, upon request, provide a reasonable alternative means of obtaining the receipt (e.g. by email). No right of withdrawal
You do not have a right of withdrawal in accordance with Section 312g(2)(9) of the German Civil Code (BGB). You cannot therefore withdraw from the contract.
Note on video surveillance
For security and prevention purposes, we use video surveillance on our premises. Please note the following important information regarding video surveillance:
Surveillance areas:
All entrances and exits, as well as selected access routes, are monitored.
Retention period and data management:
Recordings from the surveillance cameras at the entrances and exits are stored for a maximum of 72 hours and are then automatically overwritten. Recordings are not stored for longer periods unless required by law or necessary to investigate an incident. The parking bays in the car park are monitored live and no recordings are made there.
Purpose of video surveillance:
Video surveillance is used exclusively to prevent theft and to prevent unauthorised persons from gaining access. It is not used for the subsequent investigation of damage or other incidents.
Disclosure of video footage:
Video footage is released exclusively to the police upon request. It is not released to any other third parties.
We operate the video surveillance system in strict compliance with data protection regulations. If you have any questions about our surveillance system or your rights, please do not hesitate to contact us.
Liability
We, as well as our legal representatives and vicarious agents, are liable only for intent or gross negligence. Where essential contractual obligations (i.e. those obligations whose fulfilment is of particular importance for achieving the purpose of the contract) are concerned, liability also applies in cases of slight negligence. In such cases, liability is limited to the foreseeable damage typical for this type of contract. In relation to businesses, we shall be liable in the event of a grossly negligent breach of non-essential contractual obligations only to the extent of the foreseeable damage typical for this type of contract. The above exclusion of liability does not apply to liability for damage resulting from injury to life, limb or health. The provisions of the Product Liability Act also remain unaffected by this exclusion of liability. We shall not be liable for damage to, destruction of or theft of the parked motor vehicle or movable/built-in items from the motor vehicle (e.g. car radio, car telephone, mobile phone or personal valuables, photographic equipment, navigation systems, etc.) or items attached to or on the motor vehicle by third parties. The remaining liability provisions remain unaffected. The customer indemnifies McParking against damage resulting from force majeure as well as damage caused by internal and external unrest, acts of war and natural forces. McParking shall not be liable for damage to or destruction of motor vehicles, including their contents and loads, caused by the actions of third parties, e.g. other hirers or other persons.
Should a vehicle fail to start due to a technical fault, it is the customer’s responsibility to take appropriate measures. Should the vehicle fail to start upon return, McParking shall not be liable for any resulting return journey or accommodation costs. No liability is accepted for technical or mechanical defects (e.g. tyres, clutch, gearbox, etc.) in a vehicle that occur after collection and before return, no liability is accepted, nor for damage caused to a vehicle by other road users (customers) (scratches, etc.). Should such damage occur without the perpetrator being identified, this constitutes a hit-and-run incident; it is not McParking’s responsibility to pursue such cases.
If McParking staff provide jump-starting assistance to vehicles that will not start due to flat or weak batteries, this is done exclusively on the customer’s instructions and at their own risk, and without any guarantee of subsequent functionality. The hirer is obliged to inspect their vehicle upon collection before starting it and to report any damage to their vehicle to a McParking employee immediately. McParking cannot accept liability for damage that is not reported accordingly.
McParking shall be liable in accordance with statutory provisions insofar as McParking culpably breaches a material contractual obligation. In such a case, McParking’s liability shall be limited to the foreseeable, typically occurring damage. Liability for culpable injury to life, limb or health remains unaffected; this also applies to mandatory liability under the Product Liability Act, statutory liability without fault, and claims by the customer that arose prior to the conclusion of the contract.
Unless otherwise provided for above, McParking’s liability is excluded. The customer shall be liable, irrespective of fault, for all damage caused as a result of technical defects in the vehicle brought onto McParking’s premises by the customer or by a third party commissioned by the customer.
The customer hereby assigns to McParking any claims they may have against insurance companies or other third parties arising from damage for which they are responsible or resulting from a technical defect in their vehicle, insofar as McParking has suffered damage.
McParking does not guarantee that its staff are proficient in foreign languages. McParking accepts no liability for misunderstandings arising from a lack of foreign language skills on the part of its staff.
Applicable law, place of performance and jurisdiction
Unless mandatory statutory provisions under your home country’s law preclude this, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The place of performance is, depending on the parking space used, the registered office of McParking in Berlin, unless another place of performance has been expressly agreed.
Our registered office is agreed as the exclusive place of jurisdiction for all legal disputes arising from this contract, provided that you are a trader, a legal entity under public law or a special fund under public law, or provided that you do not have a place of jurisdiction in the Federal Republic of Germany or in the Republic of Poland.
